Acceptance of Terms

These Terms and Conditions (the “Terms”) govern all services, sales, and support provided by KDR Suspension LLC (“KDR”). By accessing or using any KDR service or product, you agree to be bound by these Terms. These Terms apply to all KDR customers, including individual retail clients, shops, and racing teams.

By initiating any service or purchase, or by submitting payment to KDR, you acknowledge that you have read and understood these Terms and agree to them in full. Checking an “I Agree” box or otherwise indicating acceptance (including via electronic agreement), as well as making a payment, constitutes your acceptance of these Terms and forms a legally binding contract between you and KDR Suspension LLC.

Assumption of Risk and Release of Liability

Motorsport and suspension-related services carry inherent risks. By using any products or services from KDR, you assume full responsibility for your safety and all risks associated with those products or services. KDR Suspension LLC is not liable for any injuries, accidents, damages, or mechanical failures that occur after our services or parts have been provided.

This includes, but is not limited to:

  • Improper installation or handling by you or any third party.

  • Failures of components not serviced by KDR.

  • Misuse, abuse, or unsafe operation of the vehicle or equipment.

  • Any damage, injury, or loss resulting from tuning, re-valving, or adjustments performed by KDR.

By agreeing to these Terms, you waive any and all claims against KDR Suspension LLC for the scenarios listed above. You accept that it is your sole responsibility to operate and maintain your vehicle and equipment safely after KDR’s service.

Custom Tuning and Customer Specifications

KDR specializes in custom suspension setups and tuning based on the specifications and information you provide, combined with our professional expertise. We configure your suspension according to those inputs and what we believe to be the optimal settings.

  • You are responsible for providing accurate and complete information about your vehicle and requirements. KDR is not liable for outcomes resulting from inaccurate or incomplete information.

  • Suspension performance is subjective and may vary depending on riding style, conditions, and other vehicle components. KDR does not guarantee specific results or performance outcomes.

Proper Installation and Safe Use

All parts and components serviced or sold by KDR must be installed correctly and used safely after service.

  • If KDR is not installing the parts, you are responsible for ensuring proper installation, whether by yourself or a qualified third-party mechanic.

  • Improper or unsafe installation voids any claim against KDR.

  • After service, you agree to operate the vehicle within safe and intended parameters. Misuse, abuse, or unsafe operation voids any claim against KDR.

“As-Is” Provision and No Warranties

All services and products provided by KDR Suspension LLC are delivered strictly “as-is”, without any warranty of any kind.

  • KDR makes no express or implied warranties or guarantees.

  • To the fullest extent permitted by law, all implied warranties are disclaimed.

  • KDR does not guarantee compatibility with aftermarket or non-OEM components unless explicitly stated in writing.

  • Any manufacturer’s warranty on parts purchased through KDR is the responsibility of the original manufacturer. KDR does not extend or process manufacturer warranties.

Inspection and Acceptance of Service

Upon completion of any service or delivery of any parts, you are responsible for promptly inspecting and testing the work or products before use.

  • If issues are found, they must be reported immediately and before use.

  • If shipped, inspect parts upon arrival and notify KDR of any problems before installation or use.

  • By accepting delivery or making payment without reporting issues, you confirm that the service or product was delivered satisfactorily and in working condition.

Indemnification

You agree to indemnify and hold harmless KDR Suspension LLC, its owners, employees, and agents from any and all claims, losses, liabilities, or expenses (including attorneys’ fees) arising from the use of any equipment or parts serviced or sold by KDR.

This includes claims brought by third parties such as friends, family, customers, team members, or others using the serviced equipment.

Racing and Competition Use

KDR Suspension LLC regularly services and tunes equipment that may be used in racing and competitive environments. We acknowledge that many of our customers are racers or performance riders. However, once work is completed and the equipment leaves our possession, KDR has no control over how the vehicle is used, maintained, or operated.

Any use of equipment serviced by KDR in racing, competition, or other high-performance activities is entirely at the customer’s own risk.

  • KDR provides no warranty, guarantee, coverage, or liability for any failures, damage, injuries, or incidents related to racing or competitive use.

  • The customer assumes all responsibility for how the equipment is used after service, regardless of whether it is entered into racing, trail riding, or other forms of use.

  • KDR does not monitor or dictate how equipment is used post-service, and such decisions are solely the responsibility of the customer.

By engaging KDR’s services, the customer acknowledges that KDR is not liable for any racing-related or post-service incidents, and that all risks associated with use of the equipment rest with the customer.

Payment Terms and No Chargebacks

  • Payment for all services and parts is due as agreed (before service, or as specified on your invoice).

  • All sales are final. Because services are custom-tailored to each customer, there are no refunds, returns, or exchanges once service is completed or parts delivered, except at KDR’s sole discretion.

  • By submitting payment, you expressly agree not to initiate chargebacks, payment disputes, or reversals with your bank, credit card provider, or payment platform.

  • Any attempt to circumvent these Terms by filing a chargeback will be treated as a breach of contract.

Late Payments

  • If any balance remains unpaid after the due date, KDR Suspension LLC reserves the right to assess a late fee of 1.5% per month (18% annually), or the maximum rate permitted by law, whichever is less.

  • This late fee will accrue each month until the balance is paid in full.

Enforcement and Recovery

In the event of an improper chargeback, payment reversal, or unpaid balance:

  • KDR Suspension LLC will dispute the chargeback by providing a copy of this agreement as evidence of your acceptance.

  • KDR may pursue full recovery of the unpaid balance through collections, reporting to credit bureaus, or legal action.

  • You agree to be responsible for all costs associated with enforcing these Terms, including but not limited to attorney’s fees, court costs, collection fees, and interest on the unpaid amount.

By paying, you acknowledge that this clause is a material part of your agreement with KDR Suspension LLC and that you waive the right to use chargebacks as a substitute for direct resolution with KDR.

Right to Refuse Service

KDR Suspension LLC reserves the right to refuse service or cancel an order at its sole discretion. If service is refused after payment has been made for unperformed work, KDR will refund the unrendered portion of the service.

Limitation of Liability

To the maximum extent permitted by law, KDR Suspension LLC shall not be liable for any special, incidental, indirect, or consequential damages arising from services or products provided.

In all cases, KDR’s total liability is limited to the amount you paid for the specific service or product at issue.

Governing Law and Venue

These Terms are governed by the laws of the State of West Virginia. Any disputes must be brought exclusively in the state or federal courts located in West Virginia. You consent to the jurisdiction of those courts and waive objections to venue.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Acknowledgment and Binding Agreement

By checking the box labeled “I agree to the Terms & Conditions”, signing a physical copy, or submitting payment for any KDR Suspension LLC service or product, you confirm that you have read, understood, and agree to all of the above Terms.

If you are agreeing on behalf of an organization, team, or shop, you affirm that you are authorized to do so and that they are also bound by these Terms.
